§ 1 - Submission of content

  1. The pilgrimage town of Kevelaer offers users of the website "kevelaer.de" the opportunity to submit content in the form of images to be published on the channels of the pilgrimage town of Kevelaer.
  2. The user's first name, surname and e-mail address are required for the submission.
  3. The user is prohibited from posting content that violates applicable law, in particular content that
    1. infringe the rights of third parties (including personal rights, copyrights, trademark rights or other intellectual property rights);
    2. are pornographic, immoral or otherwise offensive;
    3. represent anti-constitutional or extremist ideas or content from banned groups;
    4. are punishable by law, in particular inciting hatred or insulting;
    5. are unobjective or untrue;
    6. serve only to disseminate political, ideological or religious views;
    7. offer products or services for commercial purposes or advertise them directly or indirectly;
    8. impair, damage or destroy software or hardware, in particular if they contain viruses or other malware.
  4. Content may only be uploaded in the following formats and may not exceed a file size of 256 MB:
    1. JPEG (*.jpg, *.jpeg)
    2. PNG (*.png)
    3. GIF (*.gif)
  5. The pilgrimage town of Kevelaer reserves the right to exclude individual contents from publication in whole or in part at its own discretion.

§ 2 - Copyrights

  1. The user grants the pilgrimage town of Kevelaer the spatially and temporally unlimited, non-exclusive right of use to the content posted by him/her on the image portal. The pilgrimage town of Kevelaer is entitled to use, reproduce, distribute, make available by wire or wireless means on demand (online, access and transmission rights), archive and include in databases, as well as use in print media of all kinds (in particular newspapers and magazines) for its own, non-commercial purposes, while respecting the moral rights and personal rights of the user. The City is also entitled to edit and redesign the user's posted content, in particular if this is necessary for editorial and/or technical reasons and/or to combine it with other works, while respecting the moral rights of the author. The City may transfer the aforementioned rights in whole or in part to third parties without requiring the user's separate consent.
  2. The user shall not receive a fee for the granting of the aforementioned rights of use.

§ 3 Liability

  1. The user is responsible for the content posted by him/her. The user shall indemnify the pilgrimage town of Kevelaer against all claims asserted by third parties against the pilgrimage town of Kevelaer due to the infringement of rights by the user's content, unless the claims are based on edits made to the content by the town. The user is obliged to compensate the damage incurred by the pilgrimage town of Kevelaer in these cases as a result of claims by third parties. This also includes the costs of legal action.
  2. The pilgrimage town of Kevelaer is not liable for technical faults. Furthermore, the pilgrimage town of Kevelaer is not liable for damages caused by force majeure. The pilgrimage town of Kevelaer is only liable for damages caused by intentional or grossly negligent breaches of duty, as well as for the breach of essential contractual obligations. Liability is limited to damages typically foreseeable at the time of conclusion of the contract. This limitation of liability also applies to the fault of a vicarious agent or the legal representative of the pilgrimage town of Kevelaer.
